Welcome to Extravagant Stitches Embroidery. These Terms & Conditions apply to purchases, custom orders, quote requests and services provided through our website and other direct sales channels.
By placing an order, approving a quote or design proof, or submitting an item for embroidery, you acknowledge that you have reviewed and accepted the terms applicable to your order.
1. Our Services
Extravagant Stitches Embroidery provides custom machine embroidery and personalized products, including embroidery on apparel, towels, bags, caps, baby items, faith and ministry items, business merchandise, gifts and other suitable items.
We reserve the right to decline any item, design or project that we determine is unsuitable for embroidery, outside our capabilities, unsafe to embroider, unlawful, infringing or inconsistent with our business standards.
2. Quotes & Pricing
Prices may depend on:
- Product or garment cost
- Stitch count
- Design size and complexity
- Number of embroidery locations
- Quantity
- Digitizing requirements
- Personalization
- Specialty materials
- Rush service
- Shipping and other applicable charges
Quotes are estimates based on the information supplied by the customer and may be revised if the specifications change.
Applicable taxes, shipping and other charges will be disclosed as appropriate.
A quote does not reserve production time until any required approval and payment or deposit have been received.
3. Payment
Payment requirements will be communicated when an order is placed or quoted.
Custom, personalized, bulk or special-order projects may require full payment or a deposit before production begins.
Orders will not enter production until required payments, artwork and approvals have been received.
Any remaining balance must be paid according to the terms stated on the applicable invoice or quote.
4. Personalization Information
Customers are responsible for providing accurate personalization information, including:
- Names
- Initials
- Monograms
- Dates
- Numbers
- Wording
- Font selections
- Thread colors
- Sizes
- Placement instructions
Please review all information carefully before submitting or approving your order.
Extravagant Stitches Embroidery is not responsible for errors contained in information supplied or approved by the customer.
5. Design Proofs & Approval
When a proof is provided, the customer is responsible for reviewing the design carefully before approval.
Approval confirms acceptance of the applicable:
- Spelling
- Wording
- Layout
- Design
- Placement
- Approximate size
- Thread-color selections
Once approval has been given and production has started, changes may not be possible.
If changes can still be made, additional design, digitizing, material or production charges may apply.
6. Embroidery Digitizing
Artwork may need to be converted into an embroidery-ready machine file through a process known as digitizing.
Digitizing charges may apply to new or complex designs.
Digitizing is a specialized production service and does not necessarily transfer ownership of the underlying digitized embroidery file to the customer.
Unless otherwise agreed in writing, production files created or commissioned by Extravagant Stitches Embroidery for our production process remain our working files.
7. Artwork, Logos & Intellectual Property
By submitting artwork, logos, photographs, trademarks, wording or other material, you represent that you own the material or have authorization to use and reproduce it for the requested embroidery.
Customers are responsible for obtaining any necessary copyright, trademark, licensing or other permissions.
Extravagant Stitches Embroidery may refuse any design where authorization is unclear or where we reasonably believe production could violate another party's rights.
The customer is responsible for claims arising from unauthorized materials supplied by the customer, to the extent permitted by applicable law.
8. Design Limitations
Embroidery is a textile process and does not reproduce artwork in exactly the same manner as printing or a digital screen.
Some designs may need modification because of:
- Very small lettering
- Fine details
- Gradients
- Extremely complex artwork
- Fabric texture
- Garment construction
- Embroidery size limitations
We may recommend adjustments to achieve a cleaner and more durable embroidered result.
9. Thread Colors
We make reasonable efforts to match requested colors.
However, embroidery thread may differ from colors displayed on phones, monitors, printed materials, photographs, paint samples or other reference materials.
Exact color matching cannot always be guaranteed unless a specific available thread color has been mutually agreed upon.
10. Customer-Supplied Items
We may accept customer-supplied garments or products for embroidery after determining that they are suitable.
Machine embroidery involves needles, hoops, stabilizers, machinery and fabric handling. Although we exercise reasonable care, customer-supplied items inherently carry some risk during embroidery.
Customers should not submit sentimental, irreplaceable, extremely valuable or delicate items without discussing them with us first.
We reserve the right to refuse customer-supplied products that we believe are unsuitable for safe or satisfactory embroidery.
If loss or damage results directly from our failure to exercise reasonable care, any remedy will be determined in accordance with applicable law and the circumstances of the order.
11. Product & Embroidery Variations
Because embroidery and textile products have natural variations, finished items may differ slightly from photographs, samples or digital mockups.
Reasonable variations may occur in:
- Thread appearance
- Placement
- Fabric texture
- Garment dimensions
- Design positioning
- Color
- Stitch appearance
Minor variations that do not materially affect the quality or agreed design are not considered defects.
12. Turnaround Time
Production time depends on order size, design complexity, availability of products and materials, digitizing requirements and our current production schedule.
Any turnaround estimate begins only after all required:
- Order information has been received;
- Artwork and personalization have been finalized;
- Proofs have been approved, when applicable; and
- Required payment has been received.
Shipping/transit time is separate from production time.
13. Rush Orders
Rush production may be available depending on our schedule.
Additional fees may apply.
Acceptance of a rush order will be confirmed before production. Please contact us before ordering when you have a fixed event or deadline.
14. Changes After Ordering
Contact us immediately if you need to make a change.
We will make reasonable efforts to accommodate changes before production begins.
Once materials have been ordered, artwork digitized, personalization prepared or embroidery started, changes may be unavailable or subject to additional charges.
15. Cancellations
Standard, non-personalized orders may be canceled when permitted by the applicable sales channel and before fulfillment has progressed beyond the point where cancellation is practical.
Custom or personalized orders may become non-cancelable once:
- Digitizing has begun;
- A design has been approved;
- Special materials or merchandise have been ordered;
- Personalization has begun; or
- Production has started.
Any approved refund may exclude work already completed, nonrecoverable costs and applicable fees, subject to applicable law.
16. Returns & Exchanges
Because personalized and custom embroidered items are produced specifically for an individual customer, they generally cannot be returned or exchanged because of a change of mind, incorrect customer-provided information, or customer-selected size, color or design choices.
This policy does not limit any rights or remedies that cannot legally be excluded, including remedies for qualifying defective products or errors caused by us.
17. Our Errors or Defective Products
We want you to be satisfied with your order.
If you believe your order contains a production error or defect, contact us promptly after receiving it and provide:
- Your order information
- A description of the problem
- Clear photographs showing the issue
If we determine that the item materially differs from the approved order because of an error by Extravagant Stitches Embroidery, we will provide an appropriate remedy, which may include correction, replacement, refund or another mutually agreed solution, as appropriate.
Please contact us before returning any item.
18. Garment Sizes
Customers are responsible for selecting the correct garment or product size.
Sizing can vary between manufacturers, brands and product styles. When size information or charts are provided, please review them before ordering.
Customized garments generally cannot be exchanged solely because the customer selected an incorrect size.
19. Shipping
Shipping estimates are not guarantees unless expressly stated otherwise.
Once an order has been transferred to a shipping carrier, delivery timing may be affected by circumstances outside our control.
Customers are responsible for providing an accurate and complete shipping address.
Please contact us promptly if tracking indicates a problem with your shipment so we can assist with available carrier procedures.
20. Local Pickup
Local pickup may be available for qualifying orders in the Hutto, Texas area.
Customers should wait until they receive confirmation that the order is ready before attempting pickup.
Pickup instructions will be provided when applicable.
21. Bulk, Business, Church & Organization Orders
Bulk and organizational orders may be subject to separate written quotes, invoices or project terms covering matters such as:
- Deposits
- Quantity pricing
- Garment sourcing
- Logo digitizing
- Individual personalization
- Production schedules
- Delivery
- Final payment
Where a specific written quote or agreement conflicts with these general Terms & Conditions, the specific terms agreed for that project will control to the extent of that conflict.
22. Product Care
Customers should follow the care instructions supplied with the underlying garment or product.
To help preserve embroidery:
- Use appropriate washing temperatures for the garment.
- Avoid harsh chemicals directly on embroidery.
- Turn embroidered apparel inside out when practical.
- Avoid ironing directly on embroidered thread.
- Follow the manufacturer's drying instructions.
We are not responsible for damage caused by improper washing, drying, ironing, bleaching or other misuse.
23. Photography & Portfolio Use
We may photograph completed products for quality-control and business-portfolio purposes.
We will not intentionally display sensitive personal information. If a personalized item contains information that you do not want shown publicly, please notify us when placing your order.
Where appropriate, we will seek permission before featuring customer-identifying information or proprietary business designs in promotional materials.
24. Website Information
We make reasonable efforts to keep website descriptions, photographs, pricing and availability accurate.
Occasional errors may occur. We reserve the right to correct errors and update information, subject to applicable law and any binding order already accepted.
Product availability may change without notice.
25. Privacy & Security
Personal information submitted in connection with quotes and orders will be handled in accordance with our Privacy Policy.
Customers should not send passwords, financial account credentials or other unnecessary sensitive information through quote forms, email or social media.
Payment information should be submitted only through the secure payment methods provided for the transaction.
26. Limitation of Liability
To the fullest extent permitted by applicable law, Extravagant Stitches Embroidery will not be liable for indirect, incidental, special or consequential losses arising from an order or service.
Nothing in these Terms excludes or limits liability or customer rights that cannot legally be excluded or limited.
27. Force Majeure
We will not be responsible for delays or failure to perform caused by events reasonably outside our control, including severe weather, natural disasters, carrier disruptions, power outages, equipment failures, supply shortages, governmental actions or similar circumstances.
We will communicate with affected customers and make reasonable efforts to complete outstanding orders.
28. Governing Law
These Terms & Conditions are governed by applicable federal law and the laws of the State of Texas, without limiting any consumer rights that apply under applicable law.
29. Updates to These Terms
We may revise these Terms & Conditions from time to time.
The version published on our website with its stated effective date will apply prospectively, while orders already accepted remain subject to the terms applicable when the order was accepted unless otherwise agreed or required by law.
